These Terms of Service ("Terms") govern your use of the Rekur application ("the App", "Rekur", "we", or "our") available on iOS and watchOS. By downloading, installing, or using Rekur, you agree to be bound by these Terms.
Rekur is not a medical device and does not provide medical advice.
The heart rate recovery guidance and fitness information provided by Rekur are for general wellness and informational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
You use Rekur at your own risk. Always prioritize how your body feels over what the app recommends.
You must be at least 13 years old to use Rekur. If you are under 18, you should review these Terms with a parent or guardian. By using Rekur, you represent that you meet these requirements.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Rekur on devices that you own or control, as permitted by the Apple App Store Terms of Service.

Rekur offers the following premium plans:
All purchases are processed through Apple's App Store. Payment will be charged to your Apple ID account. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period. No partial refunds are provided for unused portions of a subscription period.
Refund requests are handled by Apple in accordance with their refund policy. We do not process refunds directly.
We reserve the right to change subscription pricing. Any price changes will be communicated in advance and will not affect your current billing period. Continued use after a price change constitutes acceptance of the new pricing.

Advanced recovery analytics (recovery %, target HR, per-set breakdown, trends, and unlimited history) require an active Rekur Pro subscription or lifetime purchase.
Rekur and all associated content, design, graphics, and code are owned by us and protected by intellectual property laws.

Certain features require an Apple Watch paired with a compatible iPhone. Heart rate monitoring accuracy depends on Apple Watch hardware and fit. Rekur relies on Apple's HealthKit framework and is subject to its availability and limitations.
You can revoke Rekur's access to HealthKit data at any time through your device's Health settings.
Rekur is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or other intangible losses, resulting from:
In no event shall our total liability exceed the amount you paid for Rekur in the twelve (12) months preceding the claim.
You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses arising from your use of the App or violation of these Terms.
We reserve the right to modify these Terms at any time. Changes will be reflected by updating the "Last updated" date. Your continued use of Rekur after changes constitutes acceptance of the revised Terms.
We may terminate or suspend your access to Rekur at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us. Upon termination, your license to use the App is revoked.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Rekur shall be resolved in the courts of competent jurisdiction.
These Terms are between you and the developer of Rekur, not with Apple. Apple has no obligation to provide maintenance, support, or warranty for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if applicable). Apple has no other warranty obligation.
Apple is not responsible for addressing any claims relating to the App or your use of it, including product liability claims, consumer protection claims, or intellectual property claims.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
